Attention! U.S. Customs Stries Cargo for Undescribed Goods

As of October 7, 2024, U.S. Customs and Border Management (CBP) will implement more stringent cargo description requirements for all air cargo entering the United States. This initiative aims to improve the accuracy and security of cargo data and strengthen the supervision of imported goods.
Specifically, carriers and other interested parties that choose to submit ACAS data to Customs must provide a precise description of the goods, including an "accurate description of the goods or a 6-digit Harmonized Tariff Schedule (HTS)". In the Air Cargo Pre-Audit (ACAS) process, any vague or overly broad cargo description will not be accepted and may face rejection processing.
Prior to this, CBP had initiated an early warning phase by sending daily warning messages to key ACAS contacts indicating instances of vague descriptions that had occurred the previous day.These warnings detail descriptions of goods that are no longer accepted, such as "Gift", "Daily necessities, daily necessities", "Accessories accessories", "Parts", etc. These warning notices will be emailed to ACAS 24/7 contacts with a summary of each vague description of the previous day.

After the warning period, if the description of the goods submitted remains ambiguous, CBP will reject the relevant declaration MISSING_CARGO_DESC an error code. This code applies to cases where the description of the goods is missing or invalid. Whether it is the air transport company or the active declaration of the relevant parties, as the main body of the declaration of ACAS, it is necessary to verify whether the data meet the standards of cargo declaration, and immediately correct the problem when it is found. If CBP finds any non-compliance in the course of enforcement, it may take further action.
CBP also provides a "non-comprehensive" prohibited list of cargo descriptions, which is available on its official website. The list is not an exhaustive itemized list, but will evolve according to circumstances. The list contains some general examples that need to be programmed, such as not only numbers or special characters, must be in English, not only brand names, etc. CBP may issue a warning or denial notice for vague descriptions not explicitly listed in the inventory. Reporting entities should update the relevant reporting information and improve their software to ensure that future declarations are accurate.
In addition, CBP has recently strengthened its supervision of imported goods, especially the review of cross-border e-commerce goods. From July 2024, CBP began to strengthen the supervision of e-commerce goods, and suspended the "multiple customs declaration" to participate in the entry type T86 customs clearance qualification. This type of entry applies to duty-free imported parcels worth up to $800.
CBP pointed out that the number of imported goods claiming a $800 duty-free exemption has increased significantly in the past 10 years, from about 0.14 billion to more than 1 billion per year. This surge in the volume of duty-free goods has created difficulties in enforcing United States trade laws, health and safety requirements, intellectual property rights, consumer protection rules, and blocking the entry of illicit synthetic drugs and their raw materials and equipment into the United States.
In response to these challenges, CBP has taken a series of measures, including adjustments to entry type T86 clearance and updates to cargo description rules. At the same time, the United States also accused China's cross-border e-commerce platform of abusing the import tariff exemption policy for small packages under US $800, and plans to take a series of measures to strengthen supervision by the end of 2024, including issuing proposed rules to exclude all goods containing specific tariff products from small tax exemption, requiring small tax-free goods to provide specific additional data, and requiring importers of consumer goods to submit compliance certificates when entering the country.
In addition, CBP also implemented new safety requirements for air cargo from Europe and CIS countries in mid-August, following two incidents of burning packages in the European parcel network. These new security provisions led Korean Air Cargo to impose an embargo on shipments from these areas to the United States until 18 November.
These measures will have a significant impact on international trade, especially for e-commerce businesses that rely on fast, low-cost transportation. Therefore, relevant enterprises should pay close attention to the latest developments and policy changes of CBP to ensure that their import and export activities meet relevant requirements.
