The production and operation enterprises of export toys shall establish a perfect quality and safety control system and traceability system, strengthen the quality control and management of finished toy products, components or partial process subcontracting, establish and implement the purchase inspection and acceptance system, verify the business qualifications of suppliers and subcontractors, verify the product qualification certificate and product identification, and establish the purchase account of products and high-risk raw materials, truthfully record the product name specifications, quantity, suppliers, subcontractors and their contact information, purchase time and other content.
The competent customs shall carry out key supervision and administration of export toy production and operation enterprises under any of the following circumstances:
The safety quality control system of the (I) enterprise fails to operate effectively;
(II) the occurrence of foreign early warning notification or recall or return of shipment and the investigation by the competent customs office is indeed the responsibility of the enterprise;
(III) export toys after sampling batch inspection for 2 consecutive times, or within 6 months of a total of 3 times the safety item inspection failed;
(IV) violations of inspection and quarantine laws and regulations are subject to administrative penalties.
For enterprises that implement key supervision and management, the customs shall tighten the management of the enterprise, and increase the proportion of random inspection of the import and export products of the enterprise, and the period is generally 6 months.

In recent years, the number of intellectual property infringement lawsuits suffered by Chinese toy exporters is on the rise, and the current infringement cases mainly show the following behaviors:
● Unauthorized counterfeiting and sale of the patentee's products.
● Without the permission of the right holder, promise to sell, sell, import and manufacture products that others enjoy patent rights.
● Without the permission of the right holder, the use of patented solutions to manufacture, sell, promise to sell patented products, etc.
Therefore, toy exporters should raise awareness of intellectual property protection and actively prevent product infringement risks: first, conduct a detailed investigation and retrieval of the trademarks, patented technologies and designs involved in the goods to understand the intellectual property rights of similar competitors; If the search finds that the goods may be infringed, the patent technology and trademark design should be avoided. In order to protect their legitimate intellectual property rights, enterprises can apply for intellectual property rights in the target market and file with the Chinese customs to achieve border protection of intellectual property rights.
If the export enterprise is not clear whether the exported products are infringing. It is recommended to log on to the customs protection filing subsystem of intellectual property rights for inquiry. Enterprises can query the intellectual property rights filed with the General Administration of Customs through the system.
